CARAVAN storage lICENSE TERMS

 

CARAVAN STORAGE LICENCE AGREEMENT

This Licence Agreement sets out the terms under which Brook Storage North Wales provides secure caravan storage. By storing your vehicle with us, you agree to comply with these terms.


1. LICENCE


1.1 This is a Licence to Occupy only. It does not create a tenancy or lease and gives no exclusive right to any particular storage space.

1.2 Brook Storage North Wales reserves the right to relocate any stored vehicle within the site where necessary for operational, maintenance, security or emergency purposes.

1.3 Brook Storage North Wales reserves the right to refuse or terminate a licence where these terms are breached or where a customer's behaviour is abusive, threatening or unacceptable.


2. LICENCE PERIOD


Annual Storage Licence

• Minimum term of 12 months.

• Customers may pay annually or by the agreed payment plan.

• Customers ending the licence before the 12-month term remains liable for the outstanding balance of the licence.

• A minimum of 30 days' written notice is required before the licence end date.

• No refunds will be given for early termination.


Winter Storage Licence

• Fixed term from 1 October to 31 March.

• Payment is required in full before storage begins.

• No refunds are available.


3. PAYMENTS


Annual Storage


Option 1

Pay annually in advance and receive one month's storage free (pay for 11 months, receive 12 months' storage).


Option 2

Payment Plan:

• Three months' storage payable in advance to secure your space.

• Remaining balance payable by monthly instalments.


The payment plan is an instalment arrangement towards a fixed 12-month licence and is not a monthly rolling contract.

Failure to complete the licence term does not remove liability for any outstanding balance.

Brook Storage North Wales reserves the right to suspend access to any vehicle where payments become overdue until all outstanding amounts have been paid.

Continued non-payment may result in termination of the licence and recovery of outstanding charges together with any reasonable recovery costs.

No refunds are available once a licence has commenced.

 

4. ACCESS & SECURITY


Customer access is available:

• Monday to Saturday: 9:00am – 5:00pm

• Sunday: 10:00am – 4:00pm

The site is closed during the annual Christmas shutdown. Closure dates will be communicated in advance.


Brook Storage North Wales provides:


• 24-hour CCTV surveillance.

• A staffed site during normal business hours.

• Double electric security gates.


Customers must:

• Notify Brook Storage before removing their vehicle from the site.

• Notify Brook Storage when returning their vehicle.

• Follow all staff instructions and site signage.

• Drive safely and observe the 5mph speed limit.

• Ensure children are supervised and dogs remain on a lead.

Brook Storage North Wales reserves the right to temporarily restrict access due to maintenance, severe weather, emergencies, security concerns or non-payment.


5. INSURANCE


Customers are responsible for ensuring their vehicle remains fully insured throughout the licence period.

A valid insurance certificate must be provided before storage begins and renewed annually where applicable.

Brook Storage North Wales accepts no responsibility for loss of or damage to any vehicle or its contents, including theft, fire, vandalism, accidental damage, storm damage or any event beyond our reasonable control.

Customers store their vehicle entirely at their own risk.


6. CUSTOMER RESPONSIBILITIES


Customers must:

• Be the legal owner of the vehicle or have authority from the owner to store it.

• Keep their contact details up to date.

• Provide an emergency contact.

• Keep the vehicle secure and locked at all times.

• Ensure the vehicle is roadworthy, in a safe condition and free from leaks.

• Ensure tyres remain inflated and the vehicle can be safely moved if required.

• Remove all rubbish from the site.

Customers are responsible for any damage caused by themselves, their visitors or their vehicle to Brook Storage North Wales, neighbouring vehicles or site property.


7. SITE RULES


The following are permitted:

• Washing vehicles with prior approval.

• Minor repairs only.

• Gas bottles may remain in the vehicle provided they are turned off.

The following are strictly prohibited:

• Sleeping or staying overnight.

• Disposal of chemical toilet waste or wastewater.

• BBQs, generators or open flames.

• Storage of hazardous, illegal or explosive materials.

• Commercial trading from the site.

• Subletting or transferring this licence without written permission.


Brook Storage North Wales reserves the right to remove any person from the site who breaches these rules.

 8. BROOK STORAGE RIGHTS


Brook Storage North Wales may inspect the site and any stored vehicle externally at any reasonable time.

Where necessary for operational, safety or emergency reasons, Brook Storage North Wales may move any stored vehicle within the site.

Brook Storage North Wales reserves the right to amend these terms at any time. Updated terms will apply to all future storage licences.


9. GENERAL

Brook Storage North Wales will not be liable for any loss or damage caused by events beyond its reasonable control, including severe weather, flooding, fire, theft, vandalism, power failure or any other unforeseen event.

If any part of this Agreement is found to be unenforceable, the remaining terms shall remain in full force and effect.

This Agreement is governed by the laws of England and Wales.

INDOOR & CONTAINER STORAGE LICENSE TERMS

 

STORAGE LICENCE AGREEMENT

(Indoor & Container Storage)

This Storage Licence Agreement ("Agreement") sets out the terms under which Brook Storage North Wales ("Brook Storage", "we", "our" or "us") provides indoor and container storage facilities.

This Agreement is a Licence to Occupy only. It does not create a tenancy, lease or any legal interest in land.

By signing this Agreement or storing goods with Brook Storage North Wales, the Customer confirms they have read, understood and agree to these terms.


1. LICENCE


1.1 This Agreement grants the Customer permission to occupy a storage unit under licence only.

1.2 Brook Storage North Wales may move the Customer to another suitable storage unit where reasonably necessary for operational, maintenance, security or safety reasons.

1.3 Brook Storage North Wales reserves the right to refuse or terminate a storage licence where:

• This Agreement is breached.

• Payments remain outstanding.

• False information has been provided.

• The Customer behaves abusively, aggressively or threatens staff or other customers.

• Continued storage presents a health, safety or security risk.


2. LICENCE PERIOD


2.1 This Agreement continues until terminated by either party in accordance with these terms.

2.2 The Customer must give a minimum of 30 days' written notice to end this Agreement.

2.3 Brook Storage North Wales may terminate this Agreement immediately where the Customer seriously breaches these terms or in accordance with the Non-Payment Procedure.


3. PAYMENTS


3.1 Storage charges vary depending on the storage unit and will be recorded on the Customer Registration Form.

3.2 Before storage begins, the Customer must pay:

• Two months' storage fees in advance.

• Any agreed administration charges.

• Any charges for locks or additional services.

3.3 Following the initial advance payment, storage fees are payable monthly in advance.

3.4 Failure to pay by the due date constitutes a breach of this Agreement.

3.5 Where payment is overdue, Brook Storage North Wales may:

• Suspend access to the storage unit.

• Overlock the storage unit.

• Issue formal notices.

• Terminate this Agreement.

• Recover outstanding storage charges together with any reasonable administration, debt recovery, legal, cleaning, disposal and enforcement costs.

3.6 Where the Customer provides the required 30 days' written notice and all payments are up to date, the advance payment may be used towards the final storage period.

3.7 No refund will be given where the Customer vacates early or removes goods before the expiry of the required notice period.

 4. ACCESS TO THE STORAGE FACILITY


4.1 Brook Storage North Wales provides customer access during the following hours unless otherwise notified:

Monday to Saturday: 9:00am – 5:00pm

Sunday: 10:00am – 4:00pm

The facility may be closed on Bank Holidays, during the Christmas period, or at other times where necessary for maintenance, safety, emergencies or operational reasons.

4.2 Access outside published opening hours is strictly prohibited unless agreed in writing by Brook Storage North Wales.

4.3 Customers must securely lock their storage unit every time they leave the premises.

4.4 Customers are responsible for the security of their own lock, key or access code.

4.5 Brook Storage North Wales may request proof of identity before allowing access where keys have been lost, access codes forgotten, or where ownership of goods cannot be immediately verified.

4.6 Customers must not allow any other person to access their storage unit unless previously authorised by Brook Storage North Wales.

4.7 Customers remain fully responsible for the actions of any person they bring onto the site.

4.8 Customers must immediately report any damaged locks, attempted break-ins, suspicious behaviour or security concerns to Brook Storage North Wales.



5. SECURITY

5.1 Brook Storage North Wales operates CCTV throughout the site for the purposes of:

• Crime prevention.

• Site security.

• Staff and customer safety.

• Protection of property.

• Investigation of incidents.

• Debt recovery and legal proceedings where appropriate.

5.2 Customers acknowledge that CCTV recordings may be retained and disclosed where required by law or for the protection of Brook Storage North Wales' legitimate business interests.

5.3 The site is protected by electric security gates and monitored CCTV; however, Brook Storage North Wales does not guarantee against theft, damage, fire, flooding, vermin or any other loss.

5.4 Customers store goods entirely at their own risk and are strongly advised to ensure all goods are adequately insured.


6. CUSTOMER RESPONSIBILITIES


The Customer agrees to:

• Keep the storage unit clean, tidy and secure.

• Store goods safely so they cannot cause injury or damage.

• Ensure all goods are clean, dry and free from mould, infestation or contamination before storage.

• Notify Brook Storage North Wales immediately if any stored goods become damp, infested or hazardous.

• Keep their contact details up to date at all times.

• Maintain valid insurance covering all stored goods throughout the storage period.

• Comply with all reasonable instructions issued by Brook Storage North Wales.

• Behave respectfully towards staff, contractors and other customers.

• Leave the storage unit clean and empty when the Agreement ends.

Failure to comply with these responsibilities may result in additional cleaning charges, suspension of access, termination of this Agreement and recovery of any costs incurred by Brook Storage North Wales.

 7. PROHIBITED ITEMS


7.1 The Customer must not store, or permit any other person to store, any of the following items within the storage unit:

• Illegal, stolen or counterfeit goods.

• Firearms, ammunition, explosives or fireworks.

• Petrol, diesel, gas cylinders (unless specifically authorised), paraffin or other flammable liquids.

• Hazardous, toxic, corrosive or radioactive materials.

• Chemicals or substances likely to cause harm or contamination.

• Perishable food or drink.

• Living creatures, plants or livestock.

• Waste, rubbish or items intended for disposal.

• Controlled drugs or illegal substances.

• Items emitting strong odours.

• Cash, currency, precious metals, jewellery, gemstones or other irreplaceable valuables.

• Important documents including passports, wills, deeds or original certificates.

• Any item that could invalidate Brook Storage North Wales' insurance or place the site, staff or other customers at risk.

7.2 Brook Storage North Wales reserves the right to refuse any item it considers unsuitable for storage.

8. DANGEROUS, CONTAMINATED OR INFESTED GOODS

8.1 The Customer warrants that all goods placed into storage are clean, dry, safe and free from mould, vermin, insects and contamination.

8.2 If Brook Storage North Wales reasonably believes that any storage unit contains dangerous, contaminated or infested goods, it may immediately enter the unit without prior notice.

8.3 Brook Storage North Wales may isolate, remove, destroy or dispose of any goods where necessary to protect the health and safety of staff, customers or neighbouring storage units.

8.4 The Customer shall be responsible for all costs arising from contamination or infestation, including but not limited to:

• Pest control.

• Specialist cleaning.

• Waste disposal.

• Repairs.

• Loss of income where neighbouring units cannot be used.

• Any other reasonable costs incurred.


9. BROOK STORAGE NORTH WALES' RIGHT OF ENTRY


9.1 Brook Storage North Wales may enter a storage unit without the Customer's permission where it reasonably believes it is necessary for:

• Emergencies.

• Fire or flooding.

• Suspected illegal or prohibited items.

• Strong or unusual smells.

• Water leaks.

• Structural inspections.

• Essential repairs or maintenance.

• Health or safety concerns.

• Suspected damage to neighbouring units.

• Long-term non-payment.

• Compliance with legal obligations.

• Requests from the Police, Fire Service or other lawful authority.

9.2 Wherever reasonably practicable, Brook Storage North Wales will attempt to contact the Customer before entering the unit. However, this will not prevent immediate entry where delay could result in damage, injury or legal risk.

9.3 Brook Storage North Wales may photograph or video record the contents of a storage unit during any lawful entry for evidential, insurance, operational or legal purposes.

  7. PROHIBITED ITEMS


7.1 The Customer must not store, or permit any other person to store, any of the following items within the storage unit:

9. BROOK STORAGE NORTH WALES' RIGHT OF ENTRY


9.1 Brook Storage North Wales may enter a storage unit without the Customer's permission where it reasonably believes it is necessary for:

• Emergencies.

• Fire or flooding.

• Suspected illegal or prohibited items.

• Strong or unusual smells.

• Water leaks.

• Structural inspections.

• Essential repairs or maintenance.

• Health or safety concerns.

• Suspected damage to neighbouring units.

• Long-term non-payment.

• Compliance with legal obligations.

• Requests from the Police, Fire Service or other lawful authority.

9.3 Brook Storage North Wales may photograph or video record the contents of a storage unit during any lawful entry for evidential, insurance, operational or legal purposes.


 10. INSURANCE

10.1 The Customer is solely responsible for arranging and maintaining adequate insurance for all goods stored at Brook Storage North Wales.

10.2 Brook Storage North Wales does not insure the Customer's goods.

10.3 The Customer must maintain insurance for the full replacement value of all goods stored throughout the duration of this Agreement.

10.4 Brook Storage North Wales may request proof of insurance at any time. Failure to provide satisfactory evidence of insurance within seven (7) days may result in suspension of access or termination of this Agreement.

10.5 Brook Storage North Wales accepts no responsibility for loss of or damage to goods arising from theft, fire, flood, storm, accidental damage, vermin, insects, mould, condensation, corrosion or any other cause whatsoever, except where caused directly by Brook Storage North Wales' negligence.


11. LIABILITY

11.1 All goods are stored entirely at the Customer's own risk.

11.2 Brook Storage North Wales shall not be liable for any direct, indirect or consequential loss, loss of profits, business interruption or financial loss arising from the use of the storage facility, except where liability cannot legally be excluded.

11.3 Brook Storage North Wales shall not be responsible for damage caused by:

• Poor packing.

• Defective packaging.

• Natural deterioration.

• Vermin or insects introduced by the Customer.

• Mould, mildew or condensation.

• Mechanical or electrical failure of stored items.

• Force majeure events.

11.4 Nothing within this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be excluded under the laws of England and Wales.


12. DAMAGE TO THE STORAGE UNIT


12.1 The Customer must immediately report any damage to the storage unit or facility.

12.2 The Customer is responsible for the cost of repairing any damage caused by themselves, their visitors or contractors.

12.3 No shelving, fixtures, fittings, screws, nails, adhesives or alterations may be made to the storage unit without the prior written consent of Brook Storage North Wales.

12.4 The Customer must not interfere with electrical installations, lighting, CCTV equipment, gates or any other site infrastructure.


13. TERMINATION OF THIS AGREEMENT


13.1 The Customer may terminate this Agreement by giving Brook Storage North Wales at least thirty (30) days' written notice.

13.2 Brook Storage North Wales may terminate this Agreement immediately where the Customer:

• Fails to pay storage charges.

• Breaches this Agreement.

• Stores prohibited or dangerous goods.

• Behaves abusively or threatens staff or customers.

• Uses the storage unit for illegal purposes.

• Creates a health or safety risk.

13.3 On termination, the Customer must:

• Remove all goods.

• Leave the storage unit clean and empty.

• Return any Brook Storage North Wales property.

• Pay all outstanding charges before leaving.

13.4 Brook Storage North Wales reserves the right to recover any outstanding debt through legal action or a debt recovery agency where necessary.


 14. NON-PAYMENT PROCEDURE


14.1 Storage charges are payable in advance on the agreed due date.

14.2 If payment is not received, Brook Storage North Wales may take the following action:

Day 1 – Payment becomes overdue.

Day 7 – A payment reminder may be sent by text message, email or telephone.

Day 14 – Access to the storage unit may be suspended and Brook Storage North Wales may fit its own overlock to the storage unit.

Day 28 – A Notice of Termination may be issued by Recorded Delivery and, where possible, by email and text message.

Twenty-eight (28) days after the Notice of Termination has been served, Brook Storage North Wales may begin the Abandoned Goods Procedure.

14.3 The Customer remains liable for all outstanding storage charges, administration fees, legal costs, debt recovery costs and any other reasonable expenses incurred by Brook Storage North Wales.

14.4 Brook Storage North Wales reserves the right to refuse access to the storage unit until all outstanding sums have been paid in full.


15. ABANDONED GOODS


15.1 Goods remaining within the storage unit after termination of this Agreement shall be deemed abandoned where the Customer has failed to remove them following the Notice of Termination and the expiry of the required notice period.

15.2 Brook Storage North Wales may enter the storage unit, prepare an inventory and photograph or video record the contents.

15.3 Brook Storage North Wales may, at its absolute discretion:

• Sell the goods.

• Donate the goods to charity.

• Recycle the goods.

• Dispose of the goods.

• Destroy any goods considered unsafe, contaminated or of no commercial value.

15.4 The method of disposal shall be determined solely by Brook Storage North Wales.

15.5 Any proceeds of sale may be used to offset:

• Outstanding storage charges.

• Administration costs.

• Cleaning costs.

• Pest control costs.

• Waste disposal costs.

• Legal and debt recovery costs.

• Any other reasonable expenses incurred.

15.6 If the proceeds of sale are insufficient, the Customer remains responsible for paying the remaining balance.

15.7 Brook Storage North Wales shall not be liable for any loss suffered by the Customer as a result of goods being sold, donated, recycled or disposed of in accordance with this Agreement.


16. CLEANING, CONTAMINATION AND PESTS


16.1 The Customer must ensure all goods are clean, dry and free from mould, infestation and contamination before storage.

16.2 If a storage unit requires specialist cleaning due to mould, pests, vermin, insects, hazardous substances or waste left by the Customer, all associated costs shall be payable by the Customer.

16.3 Where contamination affects neighbouring storage units, the Customer shall also be responsible for any reasonable costs arising from cleaning, repairs, pest control and loss of income resulting from those units being temporarily unavailable.

16.4 Brook Storage North Wales may immediately remove or isolate contaminated items where necessary to protect the health and safety of staff, customers or property.


 17. GENERAL CONDITIONS


17.1 No failure or delay by Brook Storage North Wales in enforcing any provision of this Agreement shall constitute a waiver of its rights.

17.2 If any provision of this Agreement is found to be unlawful, invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17.3 Brook Storage North Wales may amend these Terms and Conditions from time to time where reasonably necessary. Customers will be given reasonable notice of any significant changes.

17.4 This Agreement constitutes the entire agreement between Brook Storage North Wales and the Customer and supersedes all previous discussions, representations or agreements relating to the storage of goods.

17.5 No person other than the Customer and Brook Storage North Wales shall have any rights under this Agreement.

17.6 The Customer may not assign, transfer or sub-let this Agreement without the prior written consent of Brook Storage North Wales.


18. DATA PROTECTION


18.1 Brook Storage North Wales will process personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

18.2 Customer information may be used for:

• Managing the storage agreement.

• Processing payments.

• Contacting the Customer.

• Security and crime prevention.

• Debt recovery.

• Insurance claims.

• Legal proceedings where necessary.

18.3 Brook Storage North Wales may share information with:

• Debt recovery agencies.

• Solicitors.

• Insurers.

• The Police.

• Government or regulatory authorities where legally required.

18.4 CCTV operates throughout the premises for security, safety, crime prevention and the protection of customers, staff and property.


19. FORCE MAJEURE


Brook Storage North Wales shall not be liable for any delay, interruption or failure to perform its obligations where caused by events beyond its reasonable control, including but not limited to:

• Fire.

• Flood.

• Storm.

• Extreme weather.

• Power failure.

• Industrial action.

• Pandemic.

• Government restrictions.

• Civil disturbance.

• Terrorism.

• Any other event beyond its reasonable control.


20. COMPLAINTS


20.1 Any complaint relating to the storage facility or this Agreement should be submitted in writing to Brook Storage North Wales.

20.2 Brook Storage North Wales aims to acknowledge complaints within five (5) working days and respond as soon as reasonably practicable.


21. GOVERNING LAW


21.1 This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

21.2 Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
